Proposition 65

Hirst & Chanler LLP has a distinguished record in bringing actions to curtail toxic chemical exposures from consumer products and food under Proposition 65, California’s voter-passed right-to-know law.  Working with individual citizen enforcers empowered by Proposition 65, we have been successful in requiring businesses to warn their customers about the risk of exposures to such known toxics as lead, cadmium, and toluene – and, often, to reformulate their products to remove such chemicals.  Successful cases have resulted in the courts imposing both injunctive relief and civil penalties, the proceeds of which are shared between the state’s toxic exposure enforcement programs and our citizen enforcer clients.

 

Hirst & Chanler LLP is proud of its product safety enforcement record, including the near-total removal of lead from soda bottles, ceramic mugs and other commonly-used household products.  The firm remains at the forefront of Proposition 65 enforcement practice, with dozens of pending cases in California.
